This document is required on such occasions the REALTOR represents both the Seller and the Buyer in the same transaction. In such cases, the licensee cannot discharge all of their responsibilities to their clients, because the obligation of confidentiality trumps the duty of full disclosure – in other words, the REALTOR cannot tell the Seller everything he knows about the Buyer’s motivations, etc, because that information is confidential. And vice versa.
Because of this limitation, both the Seller and the Buyer must affirmatively agree to accept the services of the real estate licensee – with the understanding the REALTOR cannot disclose confidential information of the other party. This form is signed by the Seller(s), Buyer(s) and licensee, and designates that all parties affirmatively agree to work under these limitations.
